Rules for advertising
Businesses
- Fairpunt's private ads are for individuals.
- Fairpunt's business ads are for business.
- At the company advertising should make it clear which company advertises.
- Companies must make it clear where the goods are delivered from.
- Companies are 100% liable for the accuracy, legality and content of the items or services they post on Fairpunt.
Individuals
- To use our services, you must be 18 years old.
- Individuals are 100% liable for the accuracy, legality and content of the items or services they post on Fairpunt.
General
- Under the category 'Buy & Sell' there can be a maximum of five items on the same listing (no services). In all other categories, only one item or service may be advertised per listing.
- Fairpunt reserves the right to edit, copy and delete listings, images, accounts and decide when a listing is business-like or not.
- Promotional prices are valid during our start-up for both individuals and businesses until further notice. Fairpunt reserves the right to change prices at any time.
Marketing & Listing Promotion
All listings and banners should follow good practice in accordance with relevant Marketing Law.Secure payments
Credit Card payments are made through Paypal's online payment system. Paypal has its own terms & conditions applicable to payments. Fairpunt never has access to your credit card details but does receive a report that shows the details of the person whose credit cards have been used to pay for services.Payment applies only for creating listings and buying banners. Other services, such as email alerts are free. Users can create an unlimited number of listings, but each listing must be paid separately and in advance.
Payment & publication
The service is exempt from the right of withdrawal. "The seller is obliged to inform you of your purchase is exempt from the right of withdrawal."When you pay for your listing and it is published on Fairpunt means that our end of the service has been provided and thus repayment shall not made. If you wish you may edit the content of your listing at no extra charge using the link you were provided with or by logging in to your account at Fairpunt and modifying or deleting your listing there.
Listings or other content that do not follow our rules are removed and no refund will be made. For removal of inappropriate and offensive listings or banners we charge an administration fee equivalent listing or banner cost.
User Generated Content
User-generated content is the kind of content that users generate on Fairpunt such as listing texts, videos and pictures. It is the user's responsibility to ensure that the published files, photos and music do not contain material protected by copyright. It is the user's responsibility to obtain permission to use such copyrighted material. Fairpunt will remove such content when requested.Advertisers and users agree to keep Fairpunt blameless for any claims for compensation from third parties on the basis of user-generated content that has violated these terms or because the user has acted in any other way in violation with these Terms of Use or in violation of any applicable law or third party rights.
The user guarantees that persons who can be identified in the user-generated content are informed and aware of how the material will be used, and expressly agree to appear in the user-generated material and are aware that this could be used for marketing purposes.
The user guarantees that they have not used direct linking to active web cameras (so called live cams) or footage from security or surveillance cameras. The user gives Fairpunt unrestricted right to dispose of the user generated content that the user generates on the site. Fairpunt may use the user-generated content such as by further processing, adapting, storing and making it available to the public.
Fairpunt's rights remain even after the user-generated content has been removed from the site.
User Responsibility
The user of the Service is solely responsible for the content of their listing, banner, uploaded images and communication with interested buyers. Fairpunt can not be held responsible for the delivery of messages that failed due any problems with external mail servers like yahoo, etc.Fairpunt takes no responsibility for listing content and images, or that the listing text corresponds to the item or service description. Nor are we responsible for the delivery or the costs associated with the purchase. Users are 100% responsible for the item which any description applies to, any payments, contact with each other as well as costs incurred for transportation and the like.
Spam Policy
We will email users in a very limited extent, and then only information pertaining to your membership or service information regarding Fairpunt. The advertiser agrees that the interested buyers may at any time submit expressions of interest regarding the listings that are active on Fairpunt. General information and further distribution of mail will not be sent to you without your active approval made in connection with registration. For continued use of the Site, we reserve the right to send out a newsletter every month.Users may not use Fairpunt as a base for advertising or other misuse. We monitor this and will take appropriate action against such activities.
Telesales & advertising via SMS or email
It is forbidden to send advertising via SMS or e-mail to the users of the service Fairpunt. It is also prohibited to conduct telephone users of the service Fairpunt.Personal data
We follow relevant law regarding Privacy of Information Acts and the Storage and usage of such information. No personal information is stored or disclosed without your active consent. Any data we do have may be disclosed to you and corrected if need be at your request. Fairpunt will never sell your personal information or email to any other company because this never has been or will be a part of our business model. We only store the information provided on the forms which are submitted, the uploaded listing images and texts and the uploader's ip address.Cookies

Fairpunt takes no responsibility for payments between advertisers and buyers, or that the description of the goods conform with the goods sold. We recommend that buyers waive bank account payments unless the parties can conclude the deal face to face.Legal Intervention

Indemnification (Remedy)
Advertisers are responsible for ensuring that the content of all pages to which their listings/banners refer to comply with our terms of use.By utilizing the services and/or goods on the site all users accept the Terms and Conditions/Terms of Use and this commits the user to abide by these terms and conditions.
Disclaimer
Companies that advertise on Fairpunt may have their own rules for their services and goods. Fairpunt is not responsible for these rules.Fairpunt can not guarantee that the service will always be 100% available. The regular operation of the site may be interfered with because of numerous factors outside Fairpunt's and our subcontractor's control. In case of technical failure, catastrophic failure of any kind, downtime or other unforeseen events Fairpunt will accredit the cost of a listing for the incurred downtime, however, at most 60 days after the listing date. This is due to technical restrictions on the part of our payment subcontractor rules.
Usage agreement - Summary
As a condition of your use of FairPunt.ie (including FairPunt.com, Fairpunt.co.uk and its related websites, services, applications and tools) you agree that you will not:- Violate any laws.
- Publish any threatening, abusive, defamatory, obscene or indecent material.
- Publish or otherwise communicate any false or misleading material or message of any kind.
- Infringe any third-party rights.
- Distribute spam, chain letters, or promote pyramid schemes.
- Distribute viruses or any other technologies that may harm FairPunt or the interests or property of FairPunt users.
- Impose or contribute to imposing an unreasonable load on our infrastructure or interfere with the proper working of FairPunt.
- Copy, modify, or distribute any other person'

- Use any robot spider, scraper or other automated means to access FairPunt and collect content for any purpose without our express written permission.
- Harvest or otherwise collect information about others, including email addresses, without their consent.
- Copy, modify or distribute rights or content from the FairPunt site, services, applications or tools or FairPunt copyrights and trademarks.
- Bypass measures used to prevent or restrict access to FairPunt, sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.Display advertising of our competitors in any form including watermarked photos, links or wording in adverts.
